These Terms of Service (“Terms”) apply to your use of the KitsSurvival website and store (the “Services”). KitsSurvival is the consumer-facing storefront of VaySafe, a preparedness-focused brand under the Vayluna group. The Services are hosted on Shopify, which provides the e-commerce platform that allows us to sell products to you.

By visiting our site, placing an order, or using any part of the Services, you agree to these Terms and to our Privacy Policy, Return & Refund Policy, and (where applicable) our Shipping Policy. If you do not agree, please do not use the Services.

1) Eligibility & accounts

You must be at least the age of majority in your place of residence to make a purchase. If you create an account, you are responsible for keeping your login details secure and for all activity under your account. You agree to provide accurate, current, and complete information when ordering.

2) Products & information

We aim to display product descriptions, specifications, and images as accurately as possible. However, minor differences may occur (for example due to lighting, packaging updates, or device display settings). Product availability can change at any time. We may limit quantities or discontinue products without notice.

Some products are intended for preparedness and practical use. Always follow included instructions and safety guidance.

3) Orders & acceptance

When you place an order, you make an offer to purchase. Your order is accepted when we confirm it and receive payment. We may refuse or cancel an order in limited cases (for example: suspected fraud, stock issues, pricing errors, or delivery constraints). If we cancel an order after payment, you will be refunded.

Please review your order carefully before submitting. If you need help, contact us as soon as possible at info@vaysafe.com. Once processing has started, changes or cancellations may no longer be possible.

4) Prices, payments & promotions

All prices shown on our store are the final prices displayed at checkout for your order. Shipping costs (if applicable) are shown at checkout before you pay. Promotions, discount codes, and offers can change or end at any time.

Payments are processed securely through our payment providers. We do not store full payment card details.

5) Shipping, delivery & risk

Delivery timeframes shown on the site are estimates and are not guaranteed. Delays can occur due to carriers, customs processing, peak periods, or events outside our control.

Risk of loss passes to you once the order is handed to the carrier. If your package arrives damaged, incomplete, or incorrect, please contact us promptly so we can help.

6) Returns, refunds & exchanges

Returns and refunds are handled according to our Return & Refund Policy. If there is any conflict between these Terms and that policy, the Return & Refund Policy will apply for return matters.

7) Prohibited use

You may not use the Services for unlawful purposes, to attempt unauthorized access, to interfere with site security, to scrape or misuse content, to transmit malware, or to submit false or misleading information. We may restrict or terminate access to the Services if misuse is detected.

8) Intellectual property

All content on the Services (including text, images, logos, design elements, and product presentation) is owned by us or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, or exploit any content without our prior written permission, except for personal, non-commercial viewing.

9) Third-party services & links

The Services may contain links or features provided by third parties. We are not responsible for third-party websites, products, or services, and your use of them is at your own risk.

10) Relationship with Shopify

The store is hosted on Shopify. Purchases made through this store are made directly with KitsSurvival / VaySafe. Shopify is not the seller of record and is not responsible for your purchase, delivery, or any product-related claims.

11) Feedback & reviews

If you submit reviews, comments, or suggestions, you grant us the right to use them for store operations and marketing (for example: displaying reviews on product pages), unless prohibited by law. You must not submit unlawful, abusive, or misleading content.

12) Disclaimer of warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available”. Nothing in these Terms limits statutory consumer rights that cannot be excluded under applicable law.

13) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential losses (such as loss of profit), or for delays and disruptions outside our reasonable control. Nothing in these Terms excludes liability where exclusion is not permitted by law.

14) Governing law

These Terms are governed by the laws of Belgium. If a dispute cannot be resolved amicably, the competent courts of Belgium will have jurisdiction, unless mandatory consumer protection laws require otherwise.

15) Changes to these Terms

We may update these Terms from time to time to reflect changes to the Services or legal requirements. The latest version will always be available on this page with an updated “Last updated” date.
